Privacy policy

The aim of this privacy policy (hereinafter Privacy policy) is to ensure the right of all natural persons visiting or using www.szputnyikshop.hu (hereinafter "online store" or "website") of informational self-determination.

Szputnyik shop takes responsibility for any given personal information, including any data you provide through the website, e-mail, on the phone or in person. 

The regulations on handling and protecting personal data are listed in the Act CXII of 2011 on Informational Self-determination and Freedom of Information.

II. Legal backround and aim of Collecting Personal Information 

Szputnyik shop may collect the following personal information after asking for consent when the user visits the Website, registers, places an order online, pays online or contacts Szputnyik shop:
name, e-mail address, postal address, billing address, payment data, company name, telephone number, IP number and device information. 

In all cases, the details requested via the Website are necessary to provide an optimal service to the user. 
Moreover the data is also used to improve our services. 


Use of Personal Information:

All the data the user provides will only be treated by Szputnyik shop for the following purposes:
• Processing the user’s order
• Contacting the user via e-mail or post (to inform them about the details of their order and to provide shipping information)
• Handling refunds
• Managing their account on the Website
• Contact the user (if there is any problem with any of their orders or for other logistical reasons)
• Respond to any of their questions.
• To send them commercial information by e-mail to inform them of new products of Szputnyik shop and the Online store, special offers and news relating to the Website and/or Szputnyik Shop in general. Moreover, to send them newsletters and catalogues.
• To improve shopping experience.

III. Duration of handling your Personal Information 

The user’s name, e-mail address, address, postal address and phone number will be preserved in our system until the user issues a written request to have them deleted.
The user’s bank account number is only stored by our online banking site, hosted by MKB Bank, and is only preserved for the identification of their order, and to handle possible refunds. 

IV.Protection of Personal Information 

We aim to provide the safest circumstances for users regarding teir personal information. Szputnyik shop only works with partners who use the latest technology in order to protect and preserve user data.
All transactions via the Website will be performed via secure payment systems. SimplePay (powered by OTP Mobil) independent payment service handles your data. The submission of your data happens outside our online store, on their offical, protected site that has the highest safety certifications.

V. Sharing Personal Information 

In order to be able to provide the best service we possibly can and in order to comply with the legal rules of running an online store we have a few third parties we work with. We might share some of your personal information with these third parties when it is necessary in order to be able to fulfill your order, and to respect applying laws.

User information will mainly be treated by Szputnyik shop for the purpose of contacting and informing the user when needed.

  • In order for you to receive your order, we share your name and address with the Hungarian Postal Services, Magyar Posta Zrt, when you choose the postal delivery option at checkout. 
  • Moreover, the invoice of your purchase will be forwarded to Ecovins Hungary accounting firm and will be held there as long as the laws require.

Apart from the parties above, we will under no circumstances give your personal information to anyone else. 

VI. User’s Rights Concerning the Treatment of Personal Information 

Szputnyik shop guarantees users that they posess all rights to access, rectify, cancel or oppose the personal details they have provided at any moment, under the terms contained in the applicable legislation. Cancel request with a copy of their National ID document attached, can be sent to order@szputnyikshop.hu, or by post to 20 Dohány Street, Budapest, 1074. The copy of your ID will be immediately destroyed as soon as we have identofyed you and deleted your data.

Users of the Website also have the right to unsubscribe from our newsletter by following the unsubscription link at the end of the letter. However, if the user decides to unsubscribe, subscription with the same e-mail address is no longer possible. In that case, user has to subscribe with a different e-mail address. 

Users have the right to collect information on the data Szputnyik shop has about them, about its handling, legislative background and duration of preservation. In that case we will inform the user within 25 days of recieving the formal demand. 

User has the right to protest data handling if the collection or the use of your Personal Information is aimed at commercial or survey use, and in cases listed in the applicable legislation. 

Users have the right to take legal measures or turn to the National Authority for Data Protection and Freedom of Information if they believe we have violated their right for data protection or mistreated them.

VII. Users Under the Age of 16

In case of the user beingunder the age of 16, their legal representative with using www.szputnyikshop.hu accepts and agrees with the following: persons under the age of 16 can only use the Online store with the supervision of a legal representative. The user’s legal representative is responsible for the user’s inernet use, in Szputnyik shop’s case, for shopping online. The legal representative bears all consequences of shopping at www.szputnyikshop.hu.

VIII. Collection and Preservation of IP Addresses

The Website servers can automatically detect the IP address and domain name used by users. An IP address is a number automatically assigned to a computer when it connects to the Internet. This information allows the subsequently processing of data in order to obtain statistics that make it possible to know the number of visits to the Website, the order of the visits, the point of access, etc Szputnyik shop only uses that data to improve its service. 

IX. Protection of Links to Other Websites 

The Website may contain links to other websites with confidentiality policies that are different to those of Szputnyik shop. Consequently, Szputnyik shop shall not be liable for the content or practices of linked websites. Szputnyik shop advises users to check the confidentiality policy of any website they access via the Website. Szputnyik shop always checks the linked pages at the time of publishing a link, in order to make sure they do not violate any laws, however, continuous monitoring without proof of violation is not possible. As soon as the Website notices a violation the link gets removed immediately. 

X. Content Liability

Szputnyik shop aims to provide the most professional service through the Website. In accordance with Ektv 7. § (1) bk. Szputnyik shop is liable for own content publisted on the Website under the terms contained in the applicable legislation.Checking and monitoring shared and/or stored information from outside sources, and investigating possible violations is not among the responsibilites of Szputnyik shop as it is stated in Ektv 7. § (2)-(3) bk. Theregulation of removal or restriction of information is not dealt with in the above mentioned act. Liability in such matters can only be determined if a specific violation is detected. On detecting a violation the affected content gets removed from the Website immediately. 

XI. Copyright 

Content created and shared by Szputnyik shop on the Website fall within the scope of hungarian legislation on copyright. Any material created by a third party is marked accordingly. Multiplication, use, spreading or selling are only possible with the written permission of the creator, or the owner of copyright. Downloading and copying the pages of the Website is only allowed for personal, noncommercial purposes. Szputnyik shop aims to respect copyright, and ask for the owner’s written permission when using material, and only share license free content.

XIII. DATA MANAGEMENT INFORMATION ON THE APPLICATION OF AN ELECTRONIC MONITORING SYSTEM IN OUR STORES 

In connection with the application of the electronic monitoring system, Reszputnyik Kft. As the Szputnyik shop K22 and D20 clothing store and showroom operated by Reszputnyik Kft. (Address: 1061 Budapest, VI. Király u. 22. (Káldy u. 1.), 1074 Budapest, Dohány u 20.) hereinafter referred to as the “Szputnik shop K22 and D20 stores”) and as data controller (hereinafter: “Data controller”), informs about:

1. We operate an electronic surveillance system (camera system) in the area of the Szputnik shop K22 and D20.

The electronic surveillance system - Act CXXXIII of 2005 on the rules for the protection of persons and property and private investigators. in accordance with Section 30 (2) and Section 31 (1) of the Act (hereinafter: the “Act”) - we use it exclusively for the purpose of property protection, in order to prevent possible infringing acts.
The purpose of data management: to protect the life and physical integrity of the persons in the area of the K22 and D20 shops of the Szputnik shop, to maintain the security of persons and property by using the electronic surveillance system (camera system). 
The personal data provided will not be used or may be used for purposes other than those specified above. The disclosure of personal data to third parties or public authorities is possible, unless otherwise required by law, with the prior express consent of the data subject.
Legal basis for data processing: your express voluntary consent [Article 6 (1) (a) GDPR] and Enforcement of the legitimate interest of the Data Controller pursuant to Section 26 (1) (e) and Section 31 (1) - (4) [Article 6 (1) (f) GDPR].
In the light of this information, the entry into the area of the K22 and D20 stores of the Szputnik shop is considered to be the consent of the data subject.
3. The electronic monitoring system operates 24 hours a day, 7 days a week, and captures images in addition to live image monitoring.
Stakeholders in the data management related to the electronic monitoring system: natural persons in the area of the Sputnik shop K22 and D20 stores, including the staff of the Sputnik shop K22 and D20 stores, as well as guests of the Sputnik shop K22 and D20 stores.
The scope of the personal data processed: the portrait of the data subjects as seen in the images and the behavior of other personal data recorded by the surveillance system.
4. Duration of data processing: a maximum of 30 days from the time the data subject enters the K22 and D20 store areas of the Sputnik shop.
Recordings made by cameras are stored for up to 30 days from the time the shot was taken. (Section 31 (3) (c) of Act CXXXIII of 2005.) 
5. The place of storage of the images is: Reszputnyik Kft. Szputnyik shop K22 and D20 stores have a closed digital video server at the cash desk. 
6. Images may only be accessed by authorized persons, as described below. 
The employees of Reszputnyik Kft. Are entitled to view the live image of the cameras. Roland Vörös, managing director, is allowed to view the recordings of the cameras, and in case of impediment, the store managers of the Kput and D20 stores in Szputnyik are entitled to do so. 
In all cases, the viewing shall be for the sole purpose indicated in point 1. Data transmission is possible only in the case of ongoing proceedings with regard to illegal conduct or breach of obligations, to the authorities and courts conducting them. The data transmitted may include recordings of relevant information made by the camera system, as well as the names of any persons on the recording.
7. The cameras monitor the entire area of the Szputnyik shop K22 and D20. We provide more information about the exact location of the cameras and the areas observed in the shops. 
8. All those concerned are entitled to the so-called affected rights. In this regard, we provide information on the following:
The Data Controller will do its utmost to enforce the rights to the processing of your personal data detailed below. 
 The data controller shall provide the possibility for the data subject to submit his / her request for the exercise of his / her rights either by post, e-mail or telephone. 
The controller shall comply with the request without undue delay, but no later than one month from the receipt of the request, and shall provide the information in a concise, transparent, comprehensible and easily accessible form. In the event of a refusal of the request, the Data Controller shall also decide within this period and inform you of the refusal of the request, the reasons for it and your legal remedies in this regard. 
 As a general rule, the Data Controller shall execute the request by e-mail, however, if you expressly request this by providing your postal or telephone contact information, the Data Controller shall execute the request by post or telephone. Upon request, telephone information can only be provided if you have verified your identity. 
The data controller does not charge a fee or reimbursement for fulfilling the request. However, in the event that a new request for the same set of data is received within one year of the previous, already completed request, the Data Controller reserves the right to charge a fee proportionate to the workload related to the performance.
1. a) Right to information and access: 
Upon request, the controller shall provide information on the following information in a concise, transparent, comprehensible and easily accessible manner: 
 - whether the processing of your personal data is in progress with the Data Controller;
- the name and contact details of the Data Controller; 
- the data processing, the name and contact details of the data processor;
- about your personal data managed by the Data Controller and their source; 
- the purpose of the processing of personal data and the legal basis for the processing; 
- the duration of the data processing; 
- the recipients or categories of recipients to whom or with whom the personal data have been or will be communicated, including in particular third country recipients or international organizations; 
- the consequences of data processing; 
- your rights; 
- the circumstances, effects and remedial action taken in the event of a data protection incident. 
 Even in the absence of a request, the data controller shall provide information by e-mail on any material changes in the data processing compared to the contents of this prospectus, on the circumstances and effects of the data protection incident and on the measures taken to remedy it. 
1.b) Right to rectification: 
Upon request, the data controller will correct inaccurate personal data concerning you. 
 The controller shall inform all recipients to whom or with whom the personal data have been communicated of the rectification, unless this proves impossible or requires a disproportionate effort. Upon request, the Data Controller will inform the recipients. 
1. c) Right of cancellation: 
Upon request, the Data Controller will delete your personal data if one of the following reasons exists: 
 - personal data are no longer required for the purpose for which they were collected or otherwise processed; 
- withdraw the consent; 
- you protest against the data processing;
- the Personal Data was processed unlawfully by the Data Controller; 
- personal data must be deleted in order to fulfill a legal obligation prescribed by EU or Hungarian law applicable to the Data Controller. 
The controller shall inform all recipients to whom or with whom the personal data have been communicated of the deletion, unless this proves impossible or requires a disproportionate effort. Upon request, the Data Controller will inform the recipients.
1. d) Right to restrict data processing: 
Upon request, the Data Controller restricts data management if one of the following is met: 
- the accuracy of the personal data is disputed 
- in this case the restriction applies to the period of time that allows the Data Controller to check the accuracy of the personal data; 
- the data processing is illegal, but you oppose the deletion of the data and instead ask for a restriction on its use; 
- The data controller no longer needs personal data for the purpose of data processing, but you do request them to submit, enforce or protect legal claims.
 The controller shall inform all recipients to whom or with whom the personal data have been communicated of the restriction, unless this proves impossible or requires a disproportionate effort. Upon request, the Data Controller will inform the recipients. 
1. e) Right to data portability: 
Upon request, the data controller will provide you with pre-provided personal data concerning you. The Data Controller further agrees that you may transfer this personal data to another Data Controller without the Data Controller's interference. 
1. f) Right of appeal: 
If you believe that the Data Controller has violated your right to the protection of personal data in the course of its data processing, you may appeal to the competent authorities in accordance with the applicable legislation, ie you can file a complaint with the National Data Protection and Freedom of Information Authority (address: 1125 Budapest, Szilágyi Erzsébet fasor 22 / c. ; website: www.naih.hu;NAIH”) or you can apply to the competent court. 
 The controller undertakes to cooperate fully with the relevant court or the NAIH in these proceedings, and to provide the data processing data to the relevant court or the NAIH. 
The data controller also undertakes to compensate for the damage caused by the unlawful processing of your personal data or the violation of data security requirements. You can claim damages for violating your privacy. The data controller shall be released from liability if the damage was caused by an unavoidable cause outside the scope of data processing, and if the damage is caused by the intentional or grossly negligent conduct of the data subject.
